Oakland News Now Daily Jan 15 2023: Oakland Flooding, Can Sheng Thao Lead?
This is the first edition of what is a daily video-blog in the tradition of Rocketboom and called Oakland News Now Daily with some Herb Caen mixed in. What's Rocketboom? It was a three-to-five minute video-blog series that launched in 2005 and posted once a week featuring whatever news its creators Amanda Congdon and Andrew Michael Barron believed was important. It was the first of its kind and marked the emergence of video-blogging, or what we now call vlogging as an industry. Now if you have to ask who Herb Caen is, or was, that's too bad, but understandable given the passage of time. Herb Caen was the main daily columnist for the San Francisco Chronicle, and famous for a form of writing he created called “three dot journalism”. Each “item” was typed below three dots. Anyway, by the time I was old enough to be aware of him, which was 1976 in Oakland, a mention in Mr. Caen's column meant you were doing something good, bad, funny, or just interesting. Later, like around the So, in honor of that style, I'll preface each part of Oakland News Now Daily with one simple word: item. ITEM Zennie Abraham is a blogger, not a journalist. In other words, I'm not the arbiter of all truth, and I come with an expressed bias and a bite. Plus, I change my mind from time to time, and I'll let you know why. I also hate labels like “conservative” “liberal” and “progressive” and I have noticed that the decline of American society has been in direct proportion to the need for one to idenfity themselves as “conservative” “liberal” or “progressive”, rather than have an original thought. ITEM Oakland flooding has caused the closure of the Oakland ZOO, a number of streets to be underwater, and all together a lot of damage, but is anyone with the City of Oakland recording the problem? Where's Sheng Thao other than standing behind a screen in the emergency services room for a photo op? Is there a City of Oakland “Oakland Flood” website where Oaklanders can report problems and get help? Sure, there's 311, and the normal “report problems” place, but given the magnitude of the storm, don't you think something specific is needed? Oh, and what about employing tax increment financing to get some money in Oakland to help folks fix the Oakland Flood problems? Mayor Thao was big on talking about it during the campaign, but now that she's Mayor of Oakland, she's gone silent. ITEM Will Mayor Sheng Thao's partner and from my personal experience all-around good guy Andre remember not to yell at the Mayor out loud in front of people in public – or in private? ITEM A parking ticket in Oakland is north of $100 now. That's a good percentage of someone's grocery money – like all of it. Can't the City drop the ticket fee by 50 percent and not gouge folks? ITEM In her Inauguration Speech, Oakland Mayor Thao mentioned Oakland in the 1920s as if our city was the seat of all racism. Obviously Sheng never heard of Oakland resident Earl Warren, who, as Alameda County District Attorney in 1930, demolished the local KKK. Oakland's current reputation as a true place for people of all colors didn't happen overnight – it was built by people like Earl Warren. Mayor Thao, know your Oakland history. Oh, and yeah, Earl Warren was later appointed to the Supreme Court. ITEM Yes, as I vlog this, I'm in Fayette County, Georgia, helping my 88-year-old Mom while still keeping my place in Oakland (no mean trick) and once again, North Georgia has been haunted by tornados. Mom and I are safe, but the folks who need help are the ones who lost their entire homes last week. Folks like Valerie Joslin – she and her husband lost their home of 20 years. So, if you're able, go to GoFundMe.com, search “Georgia tornado” and help out. ITEM The Alameda County Board of Supervisors voted to recount the votes cast in the November 8th Election. Fine, but when does the recount process starts? And what happens if Loren Taylor wins? I'm told he would have to go to court to get Sheng, as they say, “up out of that seat” - and she would certainly file a legal challenge to that. Would they get a judge who didn't vote for one or the other? What a mess. ITEM Oakland Raiders Owner and once Oaklander Mark Davis said that he's upset that the crowds at Allegiant Stadium are mostly dressed in the colors of the opposing team, like the Kansas City Chiefs, and remarked that it's not like it was in Oakland. Did Mark Davis just sound the call for The Raiders eventual return to Oakland? Last year Zennie62Media revealed that Oakland A's Officials paced by President Dave Kaval had met with Tropicana representatives for the past five months to that date, the focus of which was a mixed-use development that included a ballpark for the MLB organization. I remarked to anyone within earshot that it looked lke the Oakland A's copied the Howard Terminal tax increment financing model and brought it to Las Vegas. I had no concrete proof to back my claim, just circumstantial evidence. But now there's more news that brings the pitcture into clear focus. On November 16th 2022, a Nevada legislative bill called “ASSEMBLY BILL NO. 10” was introduced and according to the available documents “Authorizes the designation of a tax increment area for certain transportation and housing reinvestment purposes.” Now while that may not appear to have anything to do with a ballpark, keep in mind the new law allows a land use set up where the property tax from a privately financed ballpark would pay for affordable housing – much like what the still-not-created Howard Terminal Enhanced Infrastructure Financing District in Oakland is supposed to do. The 20-page legislative work calls for the allowancve of the creation of a new tax increment financing zone such that any land or structure within the area has its property tax collected by Clark County and then placed into a “tax increment account”. The money from that account is to be used to retire bonds issued to pay for the specfic transportation or affordable housing (or both) development project. Save for the land use restrictions that Nevada legislation is very much like California law SB 293 Skinner, named for its author Nancy Skinner and signed into law by California Governor Gavin Newsom October 11th 2019. That law was created by Skinner working with Oakland A's President Dave Kaval and Oakland Mayor Libby Schaaf, and off of an idea I shared with Kaval on April 4th, 2017 during a scheduled 4 PM phone call. The Nevada law is necessary because standard tax increment financing rules don't allow for revenue collection to pay for affordable housing and transportation projects. The mixed use / ballpark development concept that has been under consideration in Las Vegas needed new legislation made that would allow that to happen. Enter AB10. Stay tuned.

Greenway Golf Associates, Inc. today announced that it has amicably resolved litigation with its former partner, Marc Logan. Greenway Golf Associates, Inc. is the manager and operator of Alameda’s Corica Park Golf Complex, a 333-acre municipal golf facility with two 18-hole courses, one 9-hole course, and driving range. The company holds a 40-year lease to operate the facilities with an additional 10-year renewal option. “We are pleased to have resolved the litigation with Mr. Logan,” said Umesh and Avani Patel of Oakland, Calif., who own Greenway. “We wish Mr. Logan well in his future endeavors.” The settlement clears the way for Greenway to complete the re-design of the much-anticipated North Course at Corica Park, the next step—after its acclaimed re-design of the South Course—to further elevate one of the nation's top municipal golf courses. Greenway will continue with improvements of the public space to benefit the community through high quality golf experience, socially inclusive programs and outreach, demonstrated environmental stewardship, and sound fiscal management. Mr. Patel said that Greenway expects to make a major announcement soon about its new design and construction team, which is slated to resume work on the North Course in 2023. The settlement also sharply undermines key tenets of the May 2022 lawsuit the City of Alameda filed against Greenway, which relied heavily on Mr. Logan’s now dismissed claims. “The City of Alameda unfortunately used the now amicably resolved dispute with Logan to file a baseless claim against Greenway and its management,” Mr. Patel said. A Superior Court ruling last month took issue with the City’s lawsuit against Greenway. Alameda County Superior Court Judge Frank Roesch found that Greenway had presented credible evidence that “…the City used litigation between Greenway’s shareholders (Logan) as evidence of a default of the lease, despite no determination having been made on the merits,” thus supporting Greenway’s claim that the City had acted in “bad faith.” In the same ruling, Judge Roesch also found evidence that, despite Greenway’s full compliance with the lease, the City had wrongfully interfered with Greenway’s right to operate the golf course. In a separate ruling last month in Alameda County Superior Court, the City suffered a further setback when the Court ordered that Umesh Patel be removed as a co-defendant in the City’s lawsuit against Greenway, stating “the facts alleged are insufficient to support a claim against Patel for breach of contract and therefore the same is true for Plaintiff’s claim for breach of the covenant of good faith.” The City’s lawsuit aside, the Patels believe the amicable settlement of the litigation with Mr. Logan is the beginning of a new chapter and the start of great things for Corica Park, for golfers of all ages and skill levels, and for wider community benefit. “The Greenway team is committed to providing a high-quality golfing experience, to moving forward with exciting course improvements, and to increase inclusive opportunities for all Alameda and East Bay residents to enjoy Corica Park,” said the Patels. 1/5/2023 - Alameda County Ranked Choice Voting - Board of Supervisors Special Meeting This is my public comment regarding the use of ranked choice voting in Alameda County during the November election. I mention how if the County were using open-source software, members of the public could have spotted the County's misconfiguration of the RCV tabulator sooner.
